Justice delayed (now it’s official) –

Published by Mark Tattersall in Court system · 1/7/2019 16:29:50

Two of the most senior judges have acknowledged the unacceptable level of service that is being provided by the “divorce centres” (that small number of courts (11) through which divorce proceedings can now be issued). The most senior family law judge has recently said that they “have not worked well” and “indeed, some, particularly Bury St Edmunds, Liverpool and Bradford have provided a wholly unacceptable service”. His predecessor has said they have become “bywords for delay and inefficiency, essentially because HMCTS [Her Majesty’s Courts & Tribunals Service] has been unable or unwilling to furnish them with adequate numbers of staff and judges”. I would like to be able to FB post on other matters but the scandalous state of the family justice system administration is a constant thorn in the sides of family lawyers and a distraction, and more importantly, it is not delivering justice promptly to the citizens of this country. Somewhat surprisingly (and to its credit, despite its attention being focused on Brexit), the government is to reform divorce law, to bring it into the 21st-century. It’s high time it did something about administration of the family justice system. Mark Tattersall, director-solicitor at Chivers Walsh Family Law
